Terms of Service

1. Services

irving.studio ("we", "the platform") provides web design, digital marketing, professional photography, and a managed platform for local businesses in Tenerife and the Canary Islands.

2. Custom Build Model

Custom Build projects are one-time payment web design services. The client receives full ownership of the website upon complete payment. Prices range from €800 to €2,500 depending on project scope. Technical support is included for 3 months after delivery.

3. Managed Platform — Commission Model

The Managed Platform operates under a commission model. irving.studio creates and manages the vendor's digital presence at no upfront cost. In return, irving.studio retains 15% of gross sales generated through the platform.

This 15% covers: website design and maintenance, hosting, SEO, social media management, content creation, digital advertising, and ongoing technical support.

4. Payments & Billing

Payments are processed through Stripe Connect. Commissions are automatically deducted from each transaction. Vendors receive their funds (minus the 15% commission) within 2-7 business days depending on payment method.

5. Vendor Obligations

Managed platform vendors agree to: (a) provide accurate information about their business, (b) maintain service quality, (c) respond to customer inquiries within a reasonable timeframe, (d) comply with all applicable laws and regulations in Spain.

6. irving.studio Obligations

irving.studio commits to: (a) designing and maintaining a professional web presence for each vendor, (b) executing digital marketing campaigns, (c) providing monthly performance reports, (d) keeping the platform operational and secure, (e) offering ongoing technical support.

7. Duration & Cancellation

The Managed Platform agreement has a minimum duration of 3 months. After this period, either party may cancel with 30 days written notice. Upon cancellation, the vendor may request export of their data and content.

8. Intellectual Property

Content created by irving.studio for the managed platform (design, marketing copy, photographs) is owned by irving.studio until agreement termination. Upon cancellation and payment of a transfer fee, the vendor may acquire content ownership.

9. Limitation of Liability

irving.studio is not liable for: indirect losses, third-party service interruptions (Stripe, hosting), or the vendor's commercial performance. Our maximum liability is limited to the commissions collected in the last 3 months.
